These Terms of Service ("Terms") govern your access to and use of the website www.cross-border-magazine.com (the "Website"), the digital and printed editions of the Cross-Border Magazine, the Cross-Border Magazine newsletter, the annual Cross-Border Magazine Awards, the Expert programme, and any other services we offer through the Website (together, the "Services").
The Services are operated and made available by Cross-Border Magazine, a publication of Salesupply B.V. ("Cross-Border Magazine", "CBM", "we", "us" or "our"), with registered office at Kerkenbos 1047, 6546 BB Nijmegen, the Netherlands, registered with the Dutch Chamber of Commerce under number 54027799. By accessing the Website, downloading the magazine, subscribing to the newsletter, contributing content, entering an award or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
These Terms should be read together with our Privacy Policy and our Cookie Policy, which describe how we process personal data. Specific Services (such as partnerships, sponsorships, awards or expert contributions) may be subject to additional terms; in case of conflict, those additional terms prevail for the relevant Service.
The Services are intended for users aged 16 or older. By using the Services, you represent that you have the legal capacity to enter into a binding agreement and, where you act on behalf of a company or other organisation, that you are authorised to bind that entity to these Terms.
We may refuse, suspend or terminate access to the Services at our reasonable discretion, in particular where you breach these Terms or where required by law.
We grant you a limited, non-exclusive, non-transferable and revocable right to access and use the Website for your personal, professional and non-commercial information purposes, in accordance with these Terms.

You can download the digital edition of Cross-Border Magazine free of charge by providing your email address (and any other information indicated as required) on the download form. By submitting the form, you ask us to send you a download link or copy of the requested issue and you confirm that the email address provided is yours or that you are authorised to use it.
The magazine is provided for your personal, professional and informational use. Editorial content reflects the views of the authors at the time of publication and is provided "as is" for general information; it does not constitute legal, tax, financial or other professional advice and should not be relied upon as such.
You may share the magazine in its original, unmodified form for non-commercial purposes, with attribution to Cross-Border Magazine. Any other reproduction, translation, adaptation or commercial use requires our prior written consent.
When you subscribe to our newsletter, we will send you editorial highlights, articles, partner content, invitations to events and webinars, and similar information by email. We send the newsletter on the basis of your consent (or, where permitted, on the basis of an existing customer relationship for similar content).
You can unsubscribe at any time, free of charge, by clicking the unsubscribe link at the bottom of every email, or by emailing [email protected]. Unsubscribing is effective for future newsletters; it does not invalidate communications already sent.
Marketing emails will indicate the sender, and where applicable any partner whose content is featured. We are responsible only for the editorial content we produce; partner content remains the responsibility of the relevant partner.
Cross-Border Magazine features expert contributions, guest articles, interviews and commentary submitted by industry professionals (the "Contributors"). If you submit content (an "Expert Contribution") for publication on the Website or in the magazine, the following applies in addition to the rules in section 3.
Originality and rights. You represent and warrant that the Expert Contribution is your own original work or that you have obtained all necessary rights and clearances; that it does not infringe any third-party intellectual property, privacy, publicity or other rights; that any factual statements are, to your reasonable knowledge, accurate; and that the Expert Contribution does not contain unlawful, defamatory or otherwise objectionable content.
Licence to us. You grant Cross-Border Magazine a worldwide, royalty-free, perpetual, irrevocable, sublicensable and transferable licence to use, reproduce, edit (for length, clarity and house style), translate, publish, distribute, display and promote the Expert Contribution in any medium now known or later developed, in connection with the Services and our marketing. Where reasonably possible, we will credit you as the author.
Editorial control. We have full editorial control over what we publish. We may edit, decline, remove or unpublish any Expert Contribution at our reasonable discretion, including for length, style, accuracy, legal or commercial reasons. Acceptance of a submission is not a guarantee of publication.
Confidentiality and disclosures. Do not include confidential information or personal data of third parties in your Expert Contribution unless you have a lawful basis to share it. You must disclose any material commercial relationship that could reasonably be perceived as influencing the content (for example, if the article promotes the products or services of your employer or a paying client).
Where the Website allows comments or other forms of interaction, you remain responsible for what you post. The rules in section 3 apply, and we may moderate, edit or remove comments that we consider, at our reasonable discretion, to violate these Terms or the rights of others.
We do not pre-screen all user-generated content. If you believe content on the Website infringes your rights or these Terms, please contact us at [email protected] so we can investigate.
The Cross-Border Magazine Awards (the "Awards") are an annual programme that recognises excellence in cross-border e-commerce. Participation in the Awards (as a nominator, nominee, sponsor or attendee) is subject to the official Award rules and any entry, judging and event terms communicated for the relevant edition (the "Award Rules"). The Award Rules form an integral part of these Terms for participants and prevail in case of conflict in respect of the Awards.
We may, at our reasonable discretion: change the categories or judging criteria; disqualify entries that do not comply with the Award Rules; cancel or postpone the event for reasons beyond our reasonable control; and use the names, logos and submitted materials of nominees and winners for editorial and promotional purposes related to the Awards.
Cross-Border Magazine works with partners, advertisers and sponsors. Partnership, advertising and sponsorship arrangements are governed by separate written agreements between Cross-Border Magazine and the relevant party (the "Partner Agreements"). These Terms do not create or modify any Partner Agreement.
Sponsored content, partner content and advertisements will be clearly identified as such, in accordance with applicable advertising and consumer-protection laws (including the Dutch Reclame Code and Article 6:194a of the Dutch Civil Code). Editorial content remains independent of commercial considerations.
We are not responsible for the products, services, websites or content of any third-party advertiser, partner or sponsor. Any transaction you enter into with a third party through the Services is at your own risk and is governed by that third party's own terms.
All content on the Website and in the magazine, including text, graphics, logos, images, videos, layout, software and the selection and arrangement of content (the "Content"), is owned by Cross-Border Magazine, Salesupply B.V., our licensors or our Contributors, and is protected by copyright, trademark, database and other intellectual property rights.
Except as expressly permitted in these Terms, you may not copy, reproduce, modify, distribute, publish, perform, transmit, sell, license, create derivative works of, or otherwise exploit any Content without our prior written consent. Personal, non-commercial use such as printing or saving an article for your own reference is permitted.
The names "Cross-Border Magazine", "CBM" and our logos are trademarks of Salesupply B.V. or its licensors. You may not use them without our prior written consent, except for fair editorial reference.
The Services may include links to and content from third parties (such as partners, social media platforms, video providers and event organisers). We do not control these third-party services and we are not responsible for their content, availability, accuracy, or terms. The fact that we link to a resource is not an endorsement.
To the fullest extent permitted by law, the Services and all Content are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure or free of viruses or other harmful components.
Information published on the Website or in the magazine is provided for general information and educational purposes only. It does not constitute legal, tax, financial, investment, regulatory or other professional advice, and you should obtain advice from a qualified professional before acting on it.
Nothing in these Terms limits or excludes our liability for: (a) intentional misconduct or gross negligence; (b) death or personal injury caused by our negligence; (c) any other liability that cannot be excluded or limited under mandatory Dutch law.

Because most of our Services (the Website, the magazine, the newsletter) are provided free of charge, the limitations above reflect a reasonable allocation of risk for free services.
You agree to indemnify and hold harmless Cross-Border Magazine, Salesupply B.V., its affiliates, and their respective directors, officers, employees and agents from and against any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising from or relating to: (a) your breach of these Terms; (b) your Expert Contributions or other content you submit; (c) your violation of any applicable law or third-party right; or (d) your misuse of the Services.
These Terms apply for as long as you use the Services. You may stop using the Services at any time. We may, at our reasonable discretion and without prejudice to our other rights, suspend or terminate your access to all or part of the Services if you breach these Terms or any applicable law, or where required by a court order or supervisory authority.
Sections that by their nature are intended to survive termination (including those on intellectual property, disclaimers, limitation of liability, indemnity, governing law and jurisdiction) will survive.
We may update these Terms from time to time, for example to reflect changes in our Services, in applicable law, or for legitimate operational reasons. The current version is always available on the Website with an updated version date at the top. Material changes will be notified by a notice on the Website or, where appropriate, by email. By continuing to use the Services after the new Terms take effect, you agree to be bound by them.
Where you act as a consumer (a natural person acting outside your trade, business, craft or profession) and resident in the European Union, you have certain mandatory rights under your local consumer protection law that cannot be waived by contract. Nothing in these Terms is intended to limit those rights. The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of the Netherlands, without regard to its conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the competent court of the District Court of Gelderland (Rechtbank Gelderland), location Arnhem, the Netherlands, except where mandatory law provides otherwise (in particular for consumers, who may also bring proceedings before the courts of their place of residence).
