Understanding DAC7: How New EU Tax Rules Affect Second-Hand Buyers and Sellers

What is DAC7?

DAC7 (Directive on Administrative Cooperation 7) is a European Union directive designed to improve tax transparency across digital platforms. Effective January 1, 2023, DAC7 requires online platforms to report income earned by sellers using their services to the tax authorities.

This regulation is part of the EU's ongoing efforts to combat tax evasion and ensure fair taxation in the growing digital economy.

Who is Affected by DAC7?

1. Online Platforms

Any platform that enables users to sell goods, rent property, offer services, or share transportation falls under DAC7. This includes:

  • Marketplaces like eBay, Vinted, Etsy
  • Classifieds like Facebook Marketplace
  • Rental platforms like Airbnb

2. Sellers of Second-Hand Goods

If you sell used or second-hand items on these platforms, you may now be subject to tax authority scrutiny—even as a private individual.

3. Buyers (Indirectly)

While DAC7 primarily targets sellers, buyers may be affected if sellers adjust pricing to account for tax implications or withdraw from platforms altogether, reducing available inventory.

Reporting Requirements for Sellers

Under DAC7, platforms must report the following seller data to the relevant tax authority annually:

  • Name and address
  • Tax Identification Number (TIN)
  • Bank account information
  • Total number of transactions
  • Total revenue earned

These reports are automatically exchanged among EU tax authorities to track cross-border income.

When Do Sellers Get Reported?

Not all sellers are reported under DAC7. The following thresholds apply:

How to Stay Compliant

If you sell second-hand items online in the EU, here’s what you should do:

1. Track Your Transactions

Keep records of what you sold, when, and for how much.

2. Get a TIN

If you're close to the threshold, apply for a Tax Identification Number in your country.

3. Understand Your Local Tax Rules

Some countries offer private sales exemptions or deductions for original purchase prices. Always consult a tax advisor.

The DAC7 regulation represents a significant shift in how second-hand commerce is taxed and monitored in the EU. While casual sellers may not be immediately impacted, anyone who frequently sells on platforms like eBay, Vinted, or Facebook Marketplace should know their reporting obligations.
